By securing a reservation or utilizing our Service, you are consenting to these Terms. Should you not agree with any section of these terms, you are not permitted to use the Service.

2. Service Overview

SharedUtilityHarbour offers an array of high-end yacht charter services, which include, but are not limited to:

  • Day rentals of yachts
  • Evening yacht tours
  • Business retreats
  • Private gatherings
  • Extended yacht charters

Availability of services is contingent on factors such as weather. The scope of services is subject to change or termination at our discretion.

3. Booking and Reservations

3.1 Booking Procedure

For a reservation to be made, you must:

  • Have reached the age of majority, which is 18 years
  • Provide information that is both accurate and comprehensive
  • Remit the deposit required as specified within your booking confirmation
  • Concur with these Terms & Conditions

3.2 Confirmation

A booking is deemed confirmed only after payment has been made and we have sent a written acknowledgement. We retain the discretion to decline service to any individual.

3.3 Availability

Charter scheduling is dependent on the accessibility of vessels and favorable weather conditions. We strive to fulfill your preferences for charter dates and times to the best of our ability.

4. Payment Terms

4.1 Charges

All prices are presented in € and incorporate any applicable taxes unless indicated otherwise. We reserve the right to adjust prices without prior notification.

4.2 Payment Schedule

  • A deposit amounting to 50% of the overall charter cost is due upon reservation.
  • The remaining balance is payable 48 hours prior to the commencement of the charter.
  • Any incidental expenses: Payable upon the conclusion of the charter.

4.3 Accepted Methods of Payment

We accept most major credit cards, bank wire transfers, and certified bank drafts. Payment processing is executed through secure, encrypted arrangements.

5. Cancellation and Refund Procedures

5.1 Client Cancellations

  • More than 72 hours prior to departure: A complete refund less transaction fees
  • Between 24 to 72 hours before departure: A 50% refund
  • Less than 24 hours before departure: Non-refundable

5.2 Weather-Related Cancellations

If the charter captain deems weather conditions unsafe, our proposed alternatives are:

  • Reschedule the charter to the earliest possible availability at zero additional cost
  • Issue a complete refund if it's not possible to reschedule

5.3 Mechanical Faults

Should there be a mechanical issue with the assigned vessel, we will endeavor to provide a comparable alternative. If this can't be done, a full refund will be issued.

6. Safety and Behavior

6.1 Safety Measures

All guests are expected to:

  • Adhere to all instructions issued by the crew
  • Utilize any safety gear as required
  • Disclose any medical issues that might impact their safety
  • Stay within the designated spaces on the vessel

6.2 Restricted Articles

Prohibited items on the vessel include:

  • Containers made of glass
  • Illegal substances and items
  • Guns or any other kind of weapons
  • Excessive quantities of beverages (beyond a reasonable amount for personal consumption)
  • Animals (excluding service animals or if approval has been given in advance)

6.3 Behavior and Etiquette

Guests are required to conduct themselves respectfully. A charter may be terminated ahead of schedule with no refund should a guest's behavior be deemed unsafe or disruptive.

7. Liability and Insurance

7.1 Our Responsibility

We limit our liability to the paid amount for your charter. Not under our responsibility are:

  • Personal injuries due to a guest's own negligence
  • Loss or damage to personal belongings
  • Indirect damages or punitive losses
  • Delays caused by weather or other factors outside our influence

7.2 Insurance Policies

Our vessels and operations are protected by comprehensive marine insurance. Guests are encouraged to secure their own insurance for travel and personal items.

7.3 Acceptance of Risk

Participating in our charter services means accepting that marine activities carry inherent dangers, and you agree to assume the risks associated with your participation.

8. Adjustments to Itineraries

We may alter itineraries, paths, or schedules due to weather constraints, safety concerns, or operational needs. Our aim is always to offer experiences of similar quality.

9. Force Majeure

We cannot be held accountable for any setbacks, cancellations, or changes brought about by events beyond our control, such as:

  • Extreme climatic conditions
  • Natural catastrophes
  • Mandates from authorities
  • Shutdowns of ports
  • Equipment malfunctions

10. Privacy and Information Protection

Your private data is managed as per our Privacy Policy. Service utilization implies consent to the practices of data collection and usage outlined in our Privacy Policy.

11. Ownership of Intellectual Property

Content found on our website, which includes text, visuals, logos, and imagery, is defended by copyright and intellectual property statutes. Unauthorized reproduction, distribution, or generation of derivative works is not permitted without explicit authorization in writing.
